Sell By Auction provide an alternative and very effective sales tool for estate agents. Sell By Auction works in conjunction with their member estate agents to provide a forum to sell properties quickly by providing property auctions.
Estate Agents will retain all their commission by virtue of the agreements they currently have in place with their existing clients. Sell By Auction will not enter into any direct contact with clients of our member estate agents. The relationship between client and estate agent will continue as normal.
There are no membership fees to join. All we ask is that you supply us with a copy of your company logo, branch details and a branch contact.
In return, member agents will receive free publicity in the auction brochure and separate editorial features as and when agreed between Sell By Auction and the member estate agent.
The cost to enter a property into auction is £650 plus vat with no additional charges. This fee applies to a property being entered in to auction via an estate agent (for further information on fees please click on the relevant page).
Instructions for Agents
These instructions apply to all agents and all properties entered for sale by auction.
1. Input - Every entry must be accompanied by a fully completed Input form, (Form 1 on the website), the fee of £650 inclusive of vat and a high resolution (300dpi) image of the property.
2. Memorandum of Sale - The agent should also complete the pro-forma memorandum of sale, (Form 4) and supply this to us in duplicate - as part of the auction pack, with the documents detailed below.
3. Auction Pack - An auction pack should be available for prospective bidders to view prior to auction. The pack must be supplied to Sell By Auction no later than 4pm on the day of the auction. The completed schedule, (Form 5), should be affixed to the front of the pack, and the pack should consist of the following documents:
1. Agreement for sale - partially completed, as referred to above. (Form 4)
2. HIPS pack.
3. Mining search.
4. Copy of any documents referred to in the Land Registry Entries or if unregistered a full Abstract of Title.
5. If applicable a copy of the Lease.
6. Property information Form.
7. If the property is sold subject to a tenancy a copy of the Tenancy Agreement.
8. Special Conditions of Sale (if any) prepared by the Sellers Lawyer.
9. Auction Group Standard Sale Memorandum in duplicate - completed so far as is possible.
10. Standard schedule of enclosures - (Form 5) - to be completed and attached to the front of the pack.
4. Sellers' Solicitors - The seller's solicitors will supply the majority of the pack. You should write to the seller's solicitor as soon as their property is submitted to Sell By Auction. A suggested letter is available on the website (Form 10). You should monitor the response from the Solicitor and if necessary chase him/her for the information 7 days before the auction.
5. Seller's Entry Confirmation - You should also write to the seller confirming their auction entry. A suggested letter is available on the website (Form 9).
6. Auction Properties:
i. Every auction property must be advertised as being for sale by auction, have the date of the auction and the venue clearly clearly visible.
ii. The reserves on every property will remain confidential - the price to be advertised will be the starting bid.
iii. A Buyers Guide should be attached to all particulars sent out on all auction properties.
